These Terms of Service (“Terms”) govern your access to and use of Netpak Packaging Inc.’s (“Netpak,” “we,” “our,” “us”) website, products, and services. By using our services, you agree to be bound by these Terms. If you do not agree, you must discontinue use.

1. Website and Service Use

• You may use our website only for lawful purposes and in compliance with applicable Canadian and international laws.
• You may not interfere with the security, integrity, or performance of the website or attempt unauthorized access to data or systems.
• Website content is for informational purposes and may not be reproduced or redistributed without written permission from Netpak.

2. Quotes, Orders, and Services

• Quotes are estimates only. Orders are binding once confirmed in writing by Netpak.
• Production timelines are approximate and may change based on supply, technical requirements, or force majeure.
• Netpak reserves the right to refuse or cancel any order at its discretion.

3. Pricing and Payment

• Prices are in Canadian dollars unless otherwise specified.
• Payment terms are stated on invoices. Overdue accounts may incur interest charges or service suspension.
• Clients are responsible for taxes, duties, and applicable import/export fees.

4. Intellectual Property

• Netpak owns intellectual property in its packaging designs, trademarks, processes, and branding.
• Clients retain ownership of their logos, trademarks, and proprietary materials provided to Netpak.
• Clients grant Netpak a license to use provided materials solely for fulfilling services.

5. Confidentiality

Netpak will treat client information as confidential and will not disclose it except where necessary to deliver services or required by law.

6. Privacy

Personal information is handled in accordance with our Privacy Policy and applicable Canadian privacy laws, including PIPEDA and Québec Law 25.

7. Limitation of Liability

• Services are provided “as is” without warranties, express or implied.
• To the maximum extent allowed by law, Netpak is not liable for indirect, incidental, or consequential damages.
• Netpak’s liability is limited to the total fees paid for the order that gave rise to the claim.

8. Indemnity

You agree to indemnify and hold harmless Netpak, its employees, and affiliates from any claims or damages arising from your misuse of the website or services, or your breach of these Terms.

9. Governing Law

These Terms are governed by the laws of the Province of Québec and the federal laws of Canada. Any disputes will be handled in the courts of Montréal, Québec.

10. Changes to Terms

Netpak may update these Terms from time to time. Updates will be posted on this page with a revised “last updated” date. Continued use of our services after updates means you accept the new Terms.
